PRO CAR CHECKER TERMS AND CONDITIONS
By placing an order for an inspection with Pro Car Checker (PCC), you (Buyer) are agreeing to the following terms and conditions.
- Our Product – When purchasing an inspection package with PCC you are hiring us to inspect the overall condition of the selected vehicle. Inspectors will perform a visual inspection of the vehicle. Inspectors will not lift the vehicle or disassemble any portion of the vehicle. The inspector will use a diagnostic scanner on vehicles 1996 and newer to scan the vehicles computer system. Inspectors will road test the vehicle if permitted by the Seller/Owner. Road test will not be performed if Seller/Owner does not permit, vehicle is unsafe to be driven, or due to liability issues. Road test may also be performed by the Seller/Owner with our inspector inside. Because the inspections are visual only, not all problems may be observable at the time of inspection. Inspection results and photos will be emailed immediately to the Buyer after final review by our office.
- Service – PCC is a neutral, non biased third party inspection company. We are not affiliated with the vehicles Seller/Owner. PCC is not responsible for claims made by the Seller/Owner of any kind.
- Guarantee – Used vehicles are sold “as-is”. PCC cannot guarantee the condition of any vehicle that has been inspected by us. By purchasing a used vehicle, you agree not to hold PCC liable for any unforeseen issues that may be present with the vehicle. Our inspection cannot be used as any sort of Warranty or Guarantee of the vehicles condition.
- Limitations – Inspections will be performed unless limiting factors are present. Limiting factors include: unfavorable weather conditions such as Rain, Snow, other extreme conditions, insufficient lighting (e.g. dark parking garages). Cleanliness of the vehicle inside and out may possibly affect the accuracy of the inspection. PCC strongly advises Buyer to contact Seller/Owner to ensure the vehicle is in the best condition and location possible to ensure the inspection is done accurately. These limiting factors can greatly impact the accuracy of the inspection being done.
- Resolving Disputes –
- (a) Resolve – Prior to moving forward with filing a dispute or complaint, Buyer agrees to detail the dispute/complaint in writing to PCC and allow us at least 30 calendar days to attempt to resolve said dispute/complaint.
- (b) Mediation – After 30 calendar days, before any administrative or legal proceedings, Buyer agrees to non legal binding mediation at a location set forth by PCC. All parties are responsible for their own respective expenses for the mediation process. Buyer’s failure to mediate any dispute/complaint before legal or administrative action is taken is an acknowledgement of Buyers waiver of their dispute/complaint against PCC.
- (c) Applicable Law and Litigation – Buyer acknowledges any legal action against PCC will be done in accordance to the laws of the State of California. Any litigation will be instituted and prosecuted in either Federal or State courts located in the County of Riverside, California. Buyer and PCC waive their right to a jury trial and the right to seek a change of venue.
- Liability Limitation – In the event that the Buyer is dissatisfied with PCC’s service, Buyer agrees that PCC’s Liability is limited to refunding the Buyer the price of their inspection. PCC is not the manufacturer of the vehicle or its parts, and is not a substitute for a mechanical inspection involving disassembly of the vehicle. PCC is NOT responsible or Liable for any damages, defects or injuries that may be caused by unreported problems with the vehicle.
- Cancellation Policy – Once an inspection is purchased, Buyer can request for a full refund ONLY if PCC has not yet dispatched an inspector to inspect the vehicle. PCC reserves the right to refuse service to anyone. In the event that PCC refuses service with the Buyer, PCC will refund the Buyer of only the amount paid for the order. If the vehicle is sold before an inspector is dispatched to the location, Buyers order will be refunded in full. If the vehicle is sold after an inspector has been dispatched and inspection cannot be performed, Buyer forfeits the cost of the inspection and will not be credited for another inspection. Buyer is strongly advised to make arrangements with the Seller/Owner to hold the vehicle until it can be inspected; PCC is not responsible for making this arrangement. PCC will legally prosecute any party attempting to commit fraud by reversing charges/performing charge backs or by any other method to the fullest extent of the law.
- Seller/Owners right to Inspection information – PCC will not provide a copy of the Inspection to the vehicles Seller/Owner unless the Seller/Owner pays for the Inspection on their own. Buyer has the right to supply the Seller/Owner of the Inspection results if they please.
- Dissatisfaction – If the Buyer is dissatisfied with the inspection performed, they may submit their claim to PCC for refund consideration. Buyer must submit a claim within 7 calendar days after the inspection is sent to the Buyer. Claim must include detailed information of why the Buyer is dissatisfied with the inspection and photos of issues with vehicle if requested. Buyer agrees not to reverse charges/perform a charge back for the cost of Inspection for any reason. PCC will legally prosecute any party attempting to commit fraud by reversing charges/performing charge backs or by any other means to the fullest extent of the law.
- Unforeseeable Circumstances – In the event that PCC is delayed or cannot perform an inspection due to reasons that are beyond PCC’s control, Buyer agrees to excuse PCC of any further obligations. Circumstances such as Acts of God, inspection equipment malfunctions, local laws and restrictions, etc. may affect PCC’s ability to perform their inspection. In such instances, Buyer will be refunded the amount they paid for the inspection.
- Applicable Taxes – Prices on PCC’s website for Inspection Packages do not reflect any applicable local or State taxes. Any applicable taxes will be added to the cost of the inspection when ordered.
- Contact with Inspectors – Inspector’s are to be contacted by the Buyer only with PCC’s consent. PCC reserves the right to cancel Buyer’s inspection order and keep Buyers payment if Buyer attempts to remove PCC from the inspection process.
- Privacy Policy – PCC will not disclose Buyer’s or vehicle’s Seller/Owner personal information to any other party unless required by law. PCC does not sell, trade, or otherwise transfer to outside parties your personally identifiable information unless we provide you with advance notice. This does not include partners and other parties who assist us in conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety.
- Purchasing Policy – Buyer agrees that by purchasing an Inspection from PCC, it is for Buyer’s own personal use. Buyer agrees not to resell Inspection to another party.
- Severability – In the event that a court of competent jurisdiction finds any term or clause in this Agreement to be invalid, unenforceable, or illegal, the same will not have an impact on other terms or clauses in the Agreement or the entire Agreement. However, such a term or clause may be revised to the extent required according to the opinion of the court to render the Agreement enforceable or valid, and the rights and responsibilities of the parties shall be interpreted and enforced accordingly, so as to preserve their agreement and intent to the fullest possible extent.
